Mentoring agreement

IN AN ONLINE MEETING HELD TODAY:

On the one hand, Ms. Alba Negrón, with contact email address anegron@mentorday.es and contact tel. 922306467 as Mentoring Manager, on behalf of and in representation of MentorDay Partnership with registered office at Calle Aguere 9, Edificio Torres de Cristal, loc.01, 38005 Santa Cruz de Tenerife.

DECLARE:

That the MentorDay Association is a non-profit organisation that aims to help entrepreneurs to successfully promote their businesses, through the accompaniment of volunteer mentors organised in a mentoring programme.

That according to all the information provided to mentorDay the MENTOR/A has been identified:

That having successfully completed the programme and its accreditation, both of you are familiar with the programme and its methodology, you have been invited by mentorDay to: meet today, get to know each other better and decide to start a mentoring relationship with the support of mentorDay for which you,

AGREE:

Establish at least one mandatory fixed monthly meeting scheduled for the same day and time of each month and agreed between both parties to be held (e.g. first Tuesday of each month at 15:00 hours): 

Both may set up additional meetings, as many as they deem necessary, but there is one mandatory meeting per month, which is set out in this contract. For the first two months we recommend additional meetings to the compulsory one. 

To apply the mentoring methodology practised in the programme by means of which an expert person, in this case the mentor, helps a less experienced person, in this case the entrepreneur, to strengthen his/her skills and competences, enabling his/her personal and professional development and the consolidation of his/her new business.

Establish a space of trust and one-on-one understanding, which allows for the analysis and discussion of the problems and concerns that the entrepreneur faces in the management of the business, using open questions, active listening and assertiveness, with the aim of boosting self-confidence and strengthening the decision-making process.

For the development of the mentoring relationship, the parties (mentor, mentee and mentorDay) assume the following commitments

MENTORING COMMITMENTS:

  • Facilitating the mentor and the entrepreneur in the necessary information for the proper development of the mentoring relationship, and the mentoring programme in which they both participate and the procedures and documents necessary for the management of the mentoring programme.
  • Send to the mentor and entrepreneur(s) every month the reminder notice for the mandatory minimum meeting, with agenda notice and the subsequent sending of a satisfaction test. Being able to record content.
  • To make available to the mentor and the entrepreneur the mentoring managerwhich will carry out a follow-up of the mentoring relationshipIt is a key element in the development of the European Union's relations with the EU, strengthening it, making it easier for the parties to carry out their functions and helping to resolve any incidents that may arise.
  • Facilitate support tools such as expert consultation mentorADVISOR (+), wikiTIPS tips consultation (+), training webinar (+), mentorDay community (+), etc.
  • Promote activities of training and exchange of experience and good practices between mentors and entrepreneurs.
  • Ensure that the mentor is adequately covered against the risks of accidents. and illness directly derived from the exercise of their activity as a volunteer, in accordance with the legislation in force. Volunteer insurance.
  • Take the necessary measures to ensuring confidentiality of all the information provided by the mentor and the entrepreneur, guaranteeing the exercise of the rights of access, rectification, cancellation or opposition, in accordance with the legislation in force.

MENTOR'S COMMITMENTS:

  • Participating in the mentoring relationship offering advice and accompaniment to the entrepreneur, in a professional, close, open and sincere manner.
  • Monthly maintenance at least the minimum mandatory online session in agreement to the reminder notice sent from mentorDayThe timetable set out in the Agreements of this contract shall be complied with.
  • Advising the entrepreneur in good time in the event of having to cancel the meetingproposing a new date.
  • Be available for the entrepreneur and mentorDay to be contacted by telephone according to the agreed availability.
  • Ensure that its operations are free of charges as a mentor and have no economic or commercial interest with the entrepreneur. If there is any, the entity must be notified immediately so that a new mentor can be appointed.
  • Sharing responsibility with the entrepreneur to properly manage the mentoring relationship, reviewing it on an ongoing basis in order to enhance and improve it.
  • To help the entrepreneur to identify their needs and analyse their problemsThe aim is to stimulate and motivate him/her to find solutions and make decisions, enabling him/her to develop his/her competences.
  • Keeping all information relating to the entrepreneur and his/her business under strict confidentialityThe content of the mentoring sessions, as well as the entire content of the mentoring sessions, unless explicitly agreed by the parties.
  • Preparing meetings mentoring session respecting the agenda proposed by the entrepreneur.
  • Complete the follow-up questionnaire which mentorDay sends after each mandatory monthly meeting, responding to the topics discussed and the objective set for the next meeting. 
  • Inform the entrepreneur and mentorDay of any relevant aspect that affects the mentoring relationship and/or the viability of the business.
  • Seek support from mentorDay if the entrepreneur has a problem that goes beyond his/her experience or competence.
  • Participate in follow-up and/or closure meetings, between the mentor/entrepreneur and the entity, if convened.
  • Participate in training activities and exchange of experiences and good practices between mentors and entrepreneurs programmed by the entity.
  • Sharing responsibility with the entrepreneur to properly terminate the relationship, avoiding the creation of a dependency relationship.
  • To authorise mentorDay to disseminate information and artwork that may be useful for the promotion of the programme, provided that it does not conflict with the confidentiality commitments subscribed to in this agreement.

COMMITMENTS OF THE ENTREPRENEUR:

  • Participate in the mentoring relationshipThe mentor will be able to play an active role, following the mentor's advice and benefiting from his/her experience, without giving up making their own decisions.
  • Hold mandatory monthly meetings to the reminder notice sent from mentorDay y complete the questionnaire of subsequent follow-up.
  • Notify the mentor well in advance sufficient in the event that a meeting has to be cancelled, proposing a new date.
  • Be available for the mentor and mentorDay to be contacted according to agreed availability.
  • Managing wisely the relationship with the mentor taking into consideration the agreed time availability in Annex I.
  • Avoid any economic or commercial relationship (supplier, investor...)  with the mentor. If there are any, mentorDay should be notified immediately so that a new mentor can be appointed.
  • Accept that neither the mentor nor mentorDay, have neither legal capacity nor any decision-making responsibility for the company therefore expressly agree that none of them is or shall be liable in connection with the operation and decisions thereof.
  • Providing information required the mentor for the development of his/her functions.
  • Confidentiality. Maintain confidentiality about the information provided by the mentor and the content of the mentoring sessions, unless explicitly agreed by the parties.
  • Preparing for mentoring meetings proposing the agenda The mentor and sending it to him/her at least one day in advance.
  • Sharing responsibility with the mentor to properly manage the mentoring relationship, reviewing it on an ongoing basis in order to enhance and improve it.
  • Report the mentor and the entity of any relevant aspect of the mentor's work. affecting the mentoring relationship and/or the viability of the business.
  • Participate in online meetings follow-up and/or closure meetings between the mentor, entrepreneur and mentorDay, if convened.
  • Participate in the activities training and exchange of experiences, networking (+) (first Thursday of each month) and good practices between mentors and entrepreneurs programmed by mentorDay. 
  • Share the responsibility with the entrepreneur of properly terminate the relationship, avoiding the creation of a relationship of dependency.
  • Providing the entity with the information and the graphic material that may be useful for the promotion of the programme and authorise its dissemination.

DURATION, EXTENSION AND TERMINATION:

  • This agreement shall be concluded for a period of one year from the date of signature and shall terminate tacitly on expiry.
  • This agreement may be extended for 6 months, if this is the will of all parties, by signing an addendum to this agreement. Only one further extension of 6 months may be agreed. The mentoring relationship has a maximum total duration of 2 years. 
  • This agreement may be terminated at the request of either party provided that at least 30 days' notice is given to the other parties by signing an addendum to this agreement.

And in witness whereof, they have signed it on the date and at the place indicated at the head of the agreement.
